Terms of use

Braineos (the App) is owned by X-meta Solutions Ltd (XMETA). Any use of the App is governed by our terms of use as well as Braineos' privacy policy. Your use of the App constitutes your acceptance of these terms.

Your account

If you choose to sign up to the App, you are responsible for maintaining the security of your account and data. As a Braineos account holder, you are soley and entirely responsible for all activity associated with that account. You must notify Braineos immediately if you believe that the integrity of your account has been compromised. Braineos will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. Braineos may set storage limits for your data, or take any other measures Braineos considers appropriate to manage the App.

Content guidelines

You are fully responsible for any content you create on the App and, as such, fully responsible for any harm arising from that content. Braineos is meant to be a fun and safe place for learning. This goal has implications for your responsibilities when creating content on the App and we prohibit content that:

is abusive in any way towards any group or individual or promotes sexism, racism, violence, hatred or the exploitation of others
infringes the rights and liberties of others, including publishing information concerning any other individual without that person's consent
disrespects the copyright, trademarks or intellectual property rights of others
is pornographic or gratituously sexually explicit
is criminal or unlawful or facilitates criminal or unlawful behaviour

We further prohibit unauthorised commercial content including, but no limited to, spam and mass marketing. Likewise, users must not use the App to disseminate viruses or other malicious code.

Data licensing

Content you create on the App is done so under the Creative Commons Attribution-Non-Commercial-Share Alike 2.0 UK: England and Wales license. Furthermore, you give XMETA the right to license this content for commercial purposes. In other words, you grant XMETA the right to a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute your content in any existing or future media. Simlarly, you grant XMETA the right to sub-license these rights, and the right to bring an action for infringement of these rights.

Indemity

You hereby indemnify XMETA against any and all losses, damages, costs, liabilities and expenses incurred or suffered by us arising due to your breach of any of these terms of use.

Miscellaneous

These terms of use, inassociation with our privacy policy, represent the agreement between you and XMETA in respect to your use of the App, and as such they override any previous agreements governing your use of the App.
